Is Delta 8 Legal In Missouri? Where To Buy Delta 8 In Missouri

Legal gavel in courtroom in Missouri for delta 8 THC

The new federal laws which legalized hemp on a federal level also gave each state the power to decide whether to allow hemp and its derivatives to be legalized in their state.

Since the passing of this bill, some states have legalized hemp and all hemp-derived products, while others have banned delta 8.

Therefore to be sure you are not breaking any state laws by possessing delta 8 THC, it is prudent to know if it is legal in your state. Is delta 8 legal in Missouri? If yes, you will want to know where to buy delta 8 THC in Missouri.

This guide will provide you with the answers to these questions and more.

    Delta North

We will explore the question “is delta 8 legal in Missouri” in a bit but first, let’s look at what delta 8 THC is.

Delta 8 THC is a minor phytocannabinoid found in the hemp plant and not from the plant genus cannabis. It is naturally produced in small quantities. Delta 9, which is also a phytocannabinoid found in the hemp plant, can be converted into delta 8 THC in the lab through a chemical process called oxidation.

Delta 8 THC is psychoactive; it can make you high depending on the serving you take, although its “high” is smooth and mellow and can be a therapeutic experience if you take just the right amount of it.

This hemp-derived product has been infused in edibles such as cookies, Delta 8 Gummies, candies, or even beverages. This has made delta 8 THC one of the most popular and easiest ways to achieve a high without buying marijuana or delta 9 THC.

What is The Difference Between Delta 8 HTC and Delta 9 THC?

Delta 8 and delta 9 may be similar in their molecular structure, but they cause different effects on your body. The difference in their molecular structure is responsible for how your body reacts to these compounds.

Yes, they are both psychoactive, but the “high” produced by each is different.

Delta 8 “high” is a mild euphoric sensation that gradually kicks in to keep you calm or relaxed, while a delta 9  high creeps up on you and is more intense.

Users of delta 8 and delta 9 report that the potency of delta 8 is usually one-third of that of delta 9, which means that if you typically consume 5 mg of delta 9, you have to consume about 15mg of delta 8 THC to experience the same effects.

Before you think about possessing or using delta 8 in Missouri, you need to ask yourself this question: Is delta 8 legal in Missouri?

You may be eager to try this new player in the world of cannabinoids, but it will not be worth it if you find yourself in trouble with state laws.

Make sure you do thorough research before you buy delta 8 online or sell delta 8 in Missouri.

Likely influenced by its border states, Tennessee, Illinois, and other states like Georgia and Ohio, the state of Missouri lawmakers started legalizing hemp and its derivatives shortly after the 2018 Farm Bill was passed.

This bill which legalized hemp to be the same as agricultural hemp seed and its derived products, exempted industrial hemp from the definition of marijuana.

The state also made some amendments to its Controlled Substance Act, delisting hemp as a Schedule I Controlled Substance, publicly marketable hemp product, and all its derived products legal as long as they comply with the state industrial hemp program.

So is delta 8 legal in Missouri? Yes, it has been legal since Gov. Gretens signed the HB 2034 bill.

Not all. Delta 8 THC is legal, but delta 9 THC has a higher potency, making it a controlled substance and hence illegal on a federal level. However, in Missouri, delta 9 is legal for medicinal use.

In 2018, 65.5% of Missouri voters approved Amendment 2 for marijuana to be legalized for medicinal purposes.

A patient's physician can prescribe up to 4 ounces of dried marijuana or equivalent, and qualifying patients can also grow up to 6 hemp plants in their homes.

Although delta 9 THC is legal for medical use in Missouri, it is still illegal for recreational use.

The SB 491 classified the possession of 10 grams or less as a Class D offense which will attract a minimum fine, and possession in larger quantities may be punishable by a felony charge.

    Missouri State Hemp Amendments

The Department of Agriculture made changes to its legislature (TITLE 2- DEPARTMENT OF AGRICULTURE. DIVISION 70- PLANT INDUSTRIES, CHAPTER 17- INDUSTRIAL HEMP) on the definitions of hemp, this helped in changing the legal status of delta 8 THC in Missouri.

This legislature defined publicly marketable industrial hemp product as any industrial hemp product from living hemp plants that do not include any living hemp plant, viable seeds, viable roots, viable leaf materials, or viable floral materials and contain no material with a delta 9 THC concentration exceeding three-tenths of one percent (0.3%) on a dry weight basis.

This new amendment excluded hemp and its derivatives from the definition of marijuana or cannabis Sativa and captured delta 8, a hemp-derived product under the definition of publicly marketable hemp products, making it a legal product in Missouri.

Where to Buy Delta 8 THC in Missouri?

If you find yourself in Missouri and are looking to get some THC, you are fortunate because you are in a state where you can legally acquire delta 8 THC.

You can buy hemp products from your local dispensaries, vape shops, convenience stores, or even gas stations. However, we advise you to buy your delta 8 gummies 1000 mg online due to several benefits.

    • Buying delta 8 online gives you a chance to look at reviews of the products.
    • You will most likely get better prices and sometimes discounts when you buy online.
    • You get to see the results of the producers' certificate of analysis to know if the delta 8 product complies with state laws.
    • You get a variety of high-quality delta 8 products from hemp plants to choose from when you shop online.

It's advisable to take precautions when buying hemp products because the delta 8 market is unregulated, and there is a high possibility of fake products or products that exceed the legal limit of delta 9 THC, which causes a bad experience from taking delta 8.

Do You Need a Medical Card to Buy Delta 8?

Is delta 8 legal in Missouri? Yes. Do you need a medical card like medical marijuana to possess delta 8 in the state of Missouri? The answer is no; you do not.

Missouri hemp laws are quite lenient and do not require you to hold a medical card to possess delta 8 since it is not considered one of the controlled substances.

You can buy and use delta 8 without any medical card like other industrial hemp commodities as long as the hemp or its derived products contain the legal limit of THC, which is 0.3%.

How Old to Buy Delta 8 in Missouri?

If you are looking to buy delta 8 in Missouri and asking yourself how old to buy delta 8 in Missouri, then you will be pleased to know that the Missouri state laws don’t place age restrictions on the possession of hemp or its derived products. Retailers, however, have the right to determine the age to sell to, and most of them require that you be above 21 years old.

Can Delta 8 be Delivered to Your Home?

If the answer to the question “is delta 8 legal in Missouri?” is yes, then why does the PACT law restrict delta 8 vapes from being delivered to individual homes?

The PACT Act, passed in 2009, prohibited using the US Postal Service (USPS) to deliver cigarettes and smokeless tobacco products directly to consumers in their homes.

It was later amended in 2020, and it became “The Prevent Online Sales of E-Cigarettes to Children Act” to include Electronic Nicotine Delivery System (ENDS) - all vaping products, liquids, components, and accessories, whether they contain nicotine or not.

Due to this amendment, USPS ruled that hemp vapes and all vaping products fall under the definition of ENDS and, as such, cannot be shipped through USPS.

FedEx and UPS also took the same stand and stopped shipping hemp vapes and all vaping products, including delta 8 vapes, to consumers in their homes.

There are a few exceptions to mailing delta 8 vapes.

    • Intrastate shipping in Alaska and Hawaii is allowed.
    • Registered tobacco businesses can still ship between each other.
    • Limited shipping of vaping products by federal agencies for health purposes is allowed.
    • Adults can ship 10 electronic nicotine delivery systems for non-commercial use every 30 days.

The good news is that the PACT Act only restricts vapes. Other deltas 8 products, such as gummies, can be ordered online and delivered straight to your door.

What Does the Future hold for Delta 8 THC in Missouri?

The future is always hard to predict, especially since state or federal laws can change anytime. Therefore one can not say for sure what the future holds for delta 8 THC Missouri.

Right now, there don’t seem to be any upcoming laws regarding changes in the legalization of industrial hemp and its derived products anytime soon.

    Delta North

Delta 8 is a psychoactive compound naturally found in industrial hemp, and it's capable of causing a mellow, smooth “high,” unlike marijuana which causes a much more intense “high.”

Is delta 8 legal in Missouri? It is, thanks to the 2018 Farm Bill, which legalized industrial hemp and its derivatives on a federal level.

While delta 8 is legal for recreational use in Missouri, delta 9 from the cannabis plant is only permitted for medicinal use.

You can get all delta 8 products mailed to you in your home except THC vapes.

We hope you now have all the answers to these questions and are up to speed on the legality of delta 8 in Missouri.

Keep in mind that state laws are subject to change, so you should keep an eye out for any changes regarding hemp laws in your state.
